Most UK trading legislation creates strict liability offences. This means you can break the law unintentionally. However the law recognises genuine efforts made to comply with the legislation by including the ‘due diligence’ defence.

This essentially means implementing a management system to ensure compliance with the law (reasonable precautions) and a method to ensure that the system is followed correctly (due diligence).

An ISO 9001:2008 quality management system helps you to continually monitor and manage quality across all operations. With processes that allow you to improve the way you operate at all levels and areas of the business including for example facilities, people, training, services and equipment.

A management system does not have to be accredited to ISO9001 to provide the defence, but it is an excellent way of proving the system.

ISO9001:2008 is being replaced in 2015 with ISO9001:2015. Amongst other things there is a new structure and a risk based approach requiring the consideration of risks and opportunities and the consequences of non achievement.
