If my website uses cookies what do I need to do to make sure I comply with the Cookie Law?

Essentially the user needs to be provided with clear and comprehensive information to allow them to understand the potential consequences of allowing storage of the cookie and access to the information collected by the cookie and must give their consent to its use.

Consent must involve some form of communication where the individual knowingly indicates their acceptance. This may involve for example clicking an icon, sending an email or subscribing to a service. Implied consent is valid but you need to be satisfied that your users understand that their actions will result in cookies being set. Do not rely on the fact that they might have read a privacy policy that is hard to find or difficult to understand.
